Terms of use of the Bina programme

Divine Communications Trust (“DCT”, “we”, “us”, “our”) provides educational resources, programmes and mentoring schemes available on the website. DCT is a social enterprise, registered in England and Wales at Cambridge House, 131 – 139 Camberwell Road, London SE5 0HF.

These Terms apply to any school or organisation that purchases any of the themes of the Bina programme. You are bound to these Terms of use of the Bina programme (referred to as “the programme”). You are responsible for bringing these Terms to the attention of anyone else that may read and or use “the programme” as a result of you providing access to it.

The following items will be referred to as “the materials”:
i. PowerPoint presentations
ii. Lesson plans
iii. Pupils’ notes
iv. Exercise worksheets

All “the materials” used in “the programme” are copyright to Divine Communications Trust (“The owner”). All intellectual property rights remain with Divine Communications Trust.

The Bina programme is available ONLY by download from this website.

Please READ the following BEFORE you download any of the themes:

By downloading the theme(s), you agree to be bound by the terms of use set forth below. If you do not wish to be bound by these terms of use, you can not purchase the theme(s). Divine Communications Trust may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement on the website. You agree to review the agreement periodically to be aware of such modifications and your continued access or use of the Bina programme shall be deemed your conclusive acceptance of the modified agreement.

(a) All downloads are sold as ZIP files, so therefore you will be required to have WinZip installed on your computer to ‘EXTRACT’ the “materials”. We will not be held liable for any damage to your computer for any such installation.

(b) Due to the nature of the “materials” we sell, refunds will not be issued to consumers based on satisfaction of the features. We have tried to provide enough information on the individual themes.

(c) All sales are final, we do not offer exchanges on our themes. Please make sure to verify your order before you place it by watching the taster clips provided, and the information provided on the sequences on ‘Purchase themes’ page – Here

As a user of “the programme”

(a) You are not permitted to remove or amend any trademark, copyright or other proprietary notice

(b) You are ONLY allowed to add related content to “PowerPoint presentation”  to be used during delivery.

(c) You are not entitled to modify any of the content of “the programme” and/or “the materials”, and present or publish under another programme name or organisation name at any time.

(d) You are NOT allowed to use any of the graphic illustrations from any themes in any other way apart from it has been presented during purchase. This will be considered a infringement on our copyright.

(e) You are not to distribute, transmit, reproduce or publish by electronic or other means any part of “the materials” provided for use, to any other person outside of your school or another academic institution. This will be considered a breach of our copyright.

(f) You cannot use “the programme” and/or “the materials” in association with any other programme/material/event that is illegal, which violates or infringes upon the rights of any person; which is misleading, abusive, hateful, derogatory, obscene, profane, pornographic, threatening, vulgar; and contains errors, viruses or other harmful components, or which is otherwise actionable at law.

(g) You may not copy, display, distribute, modify, publish, reproduce, store, transmit, create derivative works from or sell or license all or any part of “the programme” and/or “the materials” to anyone at anytime.

(h) You are not permitted to add any additional letters or lettering to, distort or make any changes to any of the graphic illustrations in “the programme” and/or “the materials”

(i) DCT will not accept responsibility for any 3rd party claims or losses of any nature including, but not limited to, loss of profits, direct or indirect, special consequential damages arising from a person using “the programme” and/or “the materials”.

(j) Waiver – if you breach any of these Terms and we take no action, we will still be entitled to use our rights and remedies in any situation where there has been a breach to any of these Terms.

(k) DCT reserves the right to change, modify, add, or remove portions of these Terms in its sole discretion at anytime and without prior notice.
